Foundations and the Community Property Presumption

62 min7 τμήματαΔωρεάν κεφάλαιο

The foundation of California community property law: the three categories of marital property under Family Code §§ 760, 770 and 125, the economic community that runs from marriage to separation, the general presumption that property acquired during marriage is community property and the three ways to rebut it, who the system covers (spouses, registered domestic partners, putative spouses and unmarried cohabitants), and the four-part characterization paragraph that opens every Community Property essay.

Μαθησιακοί στόχοι

  1. 1.Define community property, separate property and quasi-community property and cite Family Code §§ 760, 770 and 125.
  2. 2.Fix the start and end of the economic community, including the date of separation under § 70 and the effect of § 771 on later earnings.
  3. 3.Apply the general community property presumption to any asset and rebut it by tracing, agreement or statute.
  4. 4.Identify who the system covers: spouses, registered domestic partners, putative spouses and Marvin cohabitants.
  5. 5.Write the four-part characterization paragraph that opens every Community Property essay.

1.1 How Community Property is tested

Community property is California’s system for deciding who owns what in a marriage. Every asset goes into one of three boxes: community, separate or quasi-community property. The box decides who manages the asset, which creditors can reach it, and who takes it at divorce or death.

Community Property is one of the six essay-only subjects; it never appears on the MBE. It appeared on 28 of the last 50 administrations, most recently in February 2024, February 2026 and July 2026 (combined with Wills; unofficial classification). The call always asks for California law, so write the Family Code and the Probate Code, not general law.

Sources of California community property law

California community property law is statutory. Family Code § 125 defines quasi-community property, and §§ 760 and 770 define community and separate property. Probate Code §§ 100 to 103 govern the effect of death. Case law fills the gaps.

Σημείωμα

The applicable-law line

The essay booklet says to answer according to legal theories and principles of general application unless a question expressly asks for California law. A Community Property question always asks for California law.

Graders score a Community Property essay with a checklist: for each asset, the presumption, the source, any title or agreement that changes the result, and each spouse’s share. Run this list for every asset, in the same order.

The Community Property attack order

Use this order in every Community Property essay. Section 6 teaches the full method, and the worked essays of later chapters apply it.

  1. 1.Step 1: State that California is a community property state and name the three dates: marriage, separation, and divorce or death.
  2. 2.Step 2: List every asset and every debt in the facts. Give each one its own heading.
  3. 3.Step 3: For each asset, write the presumption, then the source and time of acquisition.
  4. 4.Step 4: Ask whether title, a premarital agreement or a transmutation changes the character.
  5. 5.Step 5: If funds were mixed, trace or apportion. Name the method: tracing, Pereira, Van Camp, Moore.
  6. 6.Step 6: Conclude the character of the asset and each spouse’s share.
  7. 7.Step 7: Answer the call: management, creditors, division at divorce, or distribution at death.

The exam tests whether you run the same characterization steps for every asset, in order, without skipping one.

Section 2 defines the three categories. Section 3 fixes when the community begins and ends. Section 4 teaches the presumption and how a spouse rebuts it. Section 5 explains who is covered. Section 6 gives the essay template. The Review has four practice questions and one essay drill.

  2. 2.The community property presumption is the single most tested rule: 26 of the last 50 exams.
  3. 3.Every asset gets the same four-part treatment: presumption, source, title or agreement, conclusion.

1.2 Community, separate and quasi-community property

You cannot characterize an asset until you know the three boxes it can fall into. Memorize both the statutory text and the plain-English version. The exam rewards the exact words: “acquired during the marriage”, “while domiciled in this state”, “gift, bequest, devise, or descent”.

community property – Property, other than separate property, that either spouse acquires during the marriage while domiciled in California. Each spouse owns a present, equal, one-half interest.Cal. Fam. Code §§ 760, 751

ΝόμοςCA

Cal. Fam. Code § 760

Fam. Code § 760

Except as otherwise provided by statute, all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property.
Ανοιχτό κώδικα

In plain words: property a married person gets while the couple lives in California belongs to both spouses unless a statute says otherwise. “Wherever situated” means the location of the asset does not matter. A bank account in Tokyo can be community property if a California-domiciled spouse acquired it during marriage.

Στοιχεία

Elements of § 760

Property is community property under § 760 when all three are true:

  1. 1.Married person: The person who acquired the property was married, or in a registered domestic partnership, at the time.
  2. 2.During the marriage: Acquisition happened after the wedding and before the date of separation (section 3).
  3. 3.Domiciled in California: The acquiring spouse's domicile was California at acquisition: he or she lived there with the intent to remain.

Όλα τα στοιχεία που απαιτούνται.

The most common community asset is earnings. A salary, a bonus and commissions earned during marriage are all community property, because community labor produced them. Anything bought with those earnings is also community property.

separate property – Property a spouse owned before marriage, or acquired at any time by gift, bequest, devise or descent, together with the rents, issues and profits of that property.Cal. Fam. Code § 770(a)

ΝόμοςCA

Cal. Fam. Code § 770

Fam. Code § 770(a)

Separate property of a married person includes all of the following: (1) All property owned by the person before marriage. (2) All property acquired by the person after marriage by gift, bequest, devise, or descent. (3) The rents, issues, and profits of the property described in this section.
Ανοιχτό κώδικα

Three sources make separate property. First, anything a spouse already owned on the wedding day stays separate. Second, a gift or an inheritance received during marriage is separate, because no community labor earned it. A “bequest” or “devise” is a gift by will; in California a “devise” may be land or personal property (Prob. Code § 32). “Descent” means inheritance without a will. Third, income produced by separate property is separate, such as rent from a separate building.

Two more sources come from other sections. Earnings after the date of separation are separate property under § 771 (section 3). Property received in exchange for separate property is also separate: a boat bought with the proceeds of a separate house is separate.

Σημείο κλειδί

California is a community property state: the time and manner of acquisition decide the character of an asset. Title alone does not decide character; joint title matters at divorce under § 2581 (chapter 2).

Κανόνας

Present, existing and equal interests

During marriage each spouse owns a present, existing and equal one-half interest in every item of community property. Neither spouse has any interest in the separate property of the other. The interest is not a future right that appears at divorce; it exists from the moment of acquisition.

The non-earning spouse already owns half of every paycheck. That is why each spouse may leave one-half of the community property by will.

CAΔιάκριση Καλιφόρνια

Title states versus California

Γενικός κανόνας (ομοσπονδιακός / πλειοψηφικός)

In most states the spouse who earns the asset and holds the title owns it during marriage. At divorce the court divides marital property by equitable distribution, which need not be equal.

Καλιφόρνια

Ownership arises at acquisition. Each spouse holds a present, equal one-half interest regardless of title, and the court divides community and quasi-community property equally at divorce (Fam. Code § 2550).

Do not write “marital property” or “equitable distribution”. Write “community property” and “equal division”.

quasi-community property – Property acquired by a spouse while domiciled outside California that would have been community property if the spouse had been domiciled in California when it was acquired.Cal. Fam. Code § 125

ΝόμοςCA

Cal. Fam. Code § 125

Fam. Code § 125(a)

“Quasi-community property” means all real or personal property, wherever situated, acquired before or after the operative date of this code in any of the following ways: (a) By either spouse while domiciled elsewhere which would have been community property if the spouse who acquired the property had been domiciled in this state at the time of its acquisition.
Ανοιχτό κώδικα

quasi-community property solves a fairness problem. Suppose a couple marries in New York, where the husband’s salary is his own property, then moves to California and divorces here. Without a special rule the wife would get nothing from the New York years. Section 125 asks what the character would have been if the couple had lived in California at acquisition. Salary would have been community property, so the New York savings are quasi-community property.

Quasi-community property is treated as community property at divorce and at death. At divorce the court divides it equally with the community property. At the death of a spouse domiciled in California, one-half of the decedent’s quasi-community property belongs to the surviving spouse (Prob. Code § 101). The survivor’s own quasi-community property is not touched (chapter 9).

During the marriage the acquiring spouse manages quasi-community property like separate property. Creditors are the exception: for liability for debts, § 912 treats quasi-community property the same as community property (chapter 8).

Παράδειγμα

The move from Oregon

Ana and Ben marry in Oregon in 2015. Ben’s salary buys shares worth $200,000. In 2022 the couple moves to Los Angeles and buys a house with Ana’s California earnings. In 2026 Ana files for divorce in California.

Ανάλυση

The house is community property under § 760: acquired during marriage while domiciled in California. The shares were acquired while domiciled in Oregon, so § 760 does not apply. But Ben’s salary would have been community property in California, so the shares are quasi-community property under § 125.

Αποτέλεσμα

At divorce the court divides both the house and the shares equally.

Two warnings about the table. First, “during marriage” means before the date of separation, not before the divorce judgment (section 3). Second, a separate asset can lose its character. A written transmutation can make it community property, and mixing it with community funds can make tracing impossible (chapters 3 and 4).

Συμβουλή για τις εξετάσεις

Label every asset with one of three words: community, separate or quasi-community. Never write “marital”, “joint” or “his”. A missing label reads as a missed issue.

Βασικές σημειώσεις

  1. 1.§ 760: property acquired by a married person during marriage while domiciled in California is community property.
  2. 2.§ 770(a): separate property is property owned before marriage, gifts and inheritances, and the rents and profits of separate property.
  3. 3.§ 751: each spouse owns a present, existing, equal half of community property from the moment of acquisition.

  5. 5.Quasi-community property is treated as community property at divorce, at death and, for debts, under § 912.

1.3 The economic community: when it starts and ends

The word “during” in § 760 does a lot of work. Property is community only if it was acquired during the marriage. So you need a start date and an end date. The start date is clear: the wedding. The end date is the hard part, because the community usually ends before the divorce judgment. California calls the period between the two dates the economic community. Fixing its end is tested on 13 of the last 50 exams.

economic community – The period from a valid marriage to the earliest of: the date of separation, the death of a spouse, or a judgment of dissolution or legal separation.Cal. Fam. Code §§ 70, 771, 772

Κανόνας

Start and end of the economic community

The economic community begins on the date of a valid marriage. It ends on the earliest of three events: the date of separation under § 70, the death of a spouse, or a judgment of dissolution or legal separation. Earnings and accumulations after the end date are separate property.

Στοιχεία

Three events that end the economic community

Check each one against the facts and pick the earliest:

  1. 1.Separation: A complete and final break in the marital relationship, shown by expressed intent and consistent conduct (§ 70).
  2. 2.Death: The community ends at the moment of death; Probate Code §§ 100 to 101 then divide the property.
  3. 3.Judgment: A judgment of dissolution ends the marriage. After a judgment of legal separation, earnings are separate property (§ 772).

Οποιοσδήποτε αρκεί.

Under Family Code § 300, a valid marriage requires consent, a license and solemnization. A ceremony without a license, or a marriage to a person who is still married to someone else, does not create a marriage. It may still create a putative spouse, which section 5 explains. The start date is the date of the valid ceremony, not the date the couple began living together.

ΝόμοςCA

Cal. Fam. Code § 70

Fam. Code § 70(a)

“Date of separation” means the date that a complete and final break in the marital relationship has occurred, as evidenced by both of the following: (1) The spouse has expressed to the other spouse the intent to end the marriage. (2) The conduct of the spouse is consistent with the intent to end the marriage.
Ανοιχτό κώδικα

Section 70 has two elements, and both are required. First, one spouse must tell the other that the marriage is over. A private decision is not enough, and neither is a complaint to a friend. Second, that spouse’s conduct after the statement must match the statement. A spouse who says “I want a divorce” but then shares a bedroom and takes a family vacation has not shown a complete and final break. Subdivision (b) tells the court to consider all relevant evidence.

The Legislature enacted § 70 in 2016, and it took effect on January 1, 2017 (see chapter 6). Subdivision (c) says the Legislature intended to abrogate In re Marriage of Davis, the case below. Before § 70, the statute spoke of spouses “living separate and apart”, and Davis read those words to require separate homes. Under § 70, spouses can be separated while living under one roof, and spouses in separate homes may still be united. The test is intent plus conduct, not the address.

Περίπτωση

In re Marriage of Davis, (2015) 61 Cal.4th 846 (California Supreme Court 2015)

Γεγονότα

The wife told the husband that she had decided to end the marriage. The spouses then continued to live in the same house for several more years. The wife claimed the date of separation was the day of her announcement. The husband claimed there was no separation while they still shared a home.

Κράτημα

Under former § 771, “living separate and apart” required the spouses to live in separate residences. Spouses under one roof were not separated.

Γιατί έχει σημασία

The Legislature disagreed and enacted § 70, effective January 1, 2017, which abrogates Davis. Cite Davis only to explain why § 70 exists. Under current law the address is evidence, not a requirement.

ΝόμοςCA

Cal. Fam. Code § 771

Fam. Code § 771(a)

The earnings and accumulations of a spouse and the minor children living with, or in the custody of, the spouse, after the date of separation of the spouses, are the separate property of the spouse.
Ανοιχτό κώδικα

Section 771 is the consequence of separation. Everything a spouse earns after the date of separation is separate property, and so is everything bought with it. The key word is “earnings”: ask when the work was done, not when the money arrived. A bonus paid in December for work done before a June separation is community property, because the labor was community labor. A pension credit earned after separation is separate for the same reason.

Παράδειγμα

The late bonus

Cara and Dan separate on June 1, 2026, when Cara tells Dan the marriage is over and moves to an apartment. On December 15, 2026, Dan’s employer pays him a $30,000 bonus for his sales results from January to May of that year. On the same day Dan receives his December salary of $8,000.

Ανάλυση

Both payments arrive after separation, but the bonus rewards work done during the economic community. It is community property. The December salary rewards work done after separation, so it is Dan’s separate property under § 771.

Αποτέλεσμα

At divorce Cara receives one-half of the bonus and none of the December salary.

Υποθετικός

The long goodbye

Eva marries Finn in 2012 in Fresno. In March 2025 Eva tells Finn, “I do not want to be married to you anymore.” Finn asks her to think about it. They continue to share a bedroom, and in June 2025 the family takes a two-week vacation together. In August 2025 Eva opens a bank account in her own name and begins depositing her salary there. In September 2025 she moves into a rented apartment and stops sharing meals or finances with Finn. In November 2025 Eva receives $20,000 in employer stock for work she performed from January to October of that year. Finn files for divorce in January 2026 and claims the stock as community property.

When did the economic community end, and what is the character of the stock?

Ανάλυση

The issue is whether the date of separation was March, August or September 2025. Under Family Code § 70, the date of separation is the date of a complete and final break, shown by (1) an expressed intent to end the marriage and (2) conduct consistent with that intent. Here, Eva expressed her intent in March 2025. However, her conduct from March to August was not consistent with that intent: she shared a bedroom and took a family vacation. In August she began separating finances, which is some evidence of a break. Finn will argue that the break was not complete until Eva moved out and ended shared meals and finances in September. A court considering all relevant evidence under § 70(b) would most likely find the date of separation in September 2025, or possibly August. The stock was earned from January to October 2025. The portion earned before the date of separation is community property, because the labor was community labor. The portion earned after September (or August) is Eva’s separate property under § 771. Therefore, the court will apportion the stock by the time worked before and after the separation date, and Finn is entitled to one-half of the community portion.

Σημείο κλειδί

The community ends at separation, not at the divorce judgment. Property bought with post-separation earnings, in the months or years before the judgment, is separate property.

Συμβουλή για τις εξετάσεις

Write the three dates in your first paragraph: the wedding, the date of separation, and the divorce or death. Then, for every asset, say which side of the separation date it falls on. Date of separation was tested on 13 of the last 50 exams.

Βασικές σημειώσεις

  1. 1.The economic community starts at a valid marriage and ends at separation, death or judgment, whichever is first.
  2. 2.§ 70: separation needs an expressed intent to end the marriage plus conduct consistent with that intent.
  3. 3.§ 70 abrogates Davis; spouses may be separated while living in the same home.
  4. 4.§ 771: earnings after the date of separation are separate property; ask when the work was done, not when paid.

1.4 The general community property presumption and how it is rebutted

This is the most tested rule in the subject: 26 of the last 50 exams. The rule is short: property acquired during marriage is presumed to be community property, and the spouse who says otherwise must prove it. The exam skill is applying the rule to each asset, testing every rebuttal route, then concluding.

presumption – A rule that treats a fact as true unless the party who disputes it proves the opposite. To rebut a presumption is to overcome it.Cal. Evid. Code §§ 600, 606

Κανόνας

The general community property presumption

All property acquired by either spouse during marriage is presumed to be community property. The spouse who claims an asset is separate property bears the burden of proving it by a preponderance of the evidence. Property possessed by a spouse during marriage is presumed to have been acquired during marriage unless the facts show otherwise.

The first is a presumption of character: during-marriage acquisition means community property unless proved otherwise. The second is a presumption of timing. If a spouse possessed an asset during marriage and the facts do not show when it was acquired, the court assumes acquisition during marriage.

The standard of proof is a preponderance of the evidence: more likely than not. Evidence Code § 115 makes this the default standard. Do not confuse it with the form-of-title presumption in Evidence Code § 662, which needs clear and convincing proof. As Valli explains below, § 662 does not override the transmutation rules between spouses.

Στοιχεία

Three routes to rebut the presumption

The separate property claimant must fit the asset into one of these routes:

  1. 1.Tracing: Prove that the asset was bought with separate funds, by direct tracing or by exhaustion of community funds.
  2. 2.Agreement: Show a valid premarital agreement (§§ 1600 to 1617) or a written transmutation (§ 852) that makes the asset separate.
  3. 3.Statute: Point to a statute that makes the asset separate, such as § 770 (gifts, inheritance) or § 771 (post-separation earnings).

Οποιοσδήποτε αρκεί.

Μνημονικός

T-A-S

  • T– Tracing to a separate property source
  • A– Agreement: premarital agreement or written transmutation
  • S– Statute that assigns separate character, such as § 770 or § 771

Run all three for every possibly separate asset; if none applies, the asset stays community.

Tracing is the route you will use most often. A spouse who kept separate funds in a separate account traces easily: the car bought from that account is separate. The difficulty comes when separate and community money were mixed in one account, which is called commingling. Mixing does not change the character of the separate dollars, but the claimant must prove with records which dollars were separate.

Περίπτωση

See v. See, (1966) 64 Cal.2d 778 (California Supreme Court 1966)

Γεγονότα

The husband deposited his separate funds and community earnings into the same accounts over many years and paid family expenses from them. At divorce he argued that family expenses had exceeded community income over the whole marriage, so every remaining asset must be separate.

Κράτημα

Total recapitulation at the end of the marriage is not tracing. Family expenses paid from a mixed account are presumed paid from community funds. A spouse may claim a separate interest only by tracing the purchase to separate funds, or by showing that community funds were exhausted when the asset was acquired.

Γιατί έχει σημασία

The proof must be asset-by-asset and date-by-date; poor records mean the asset stays community. Direct tracing with adequate records is accepted (In re Marriage of Mix (1975) 14 Cal.3d 604).

Κανόνας

Title in one spouse’s name does not rebut the presumption

A deed, account or registration in one spouse’s name alone does not by itself rebut the community property presumption. Evidence Code § 662 does not apply where it conflicts with the transmutation statutes. Community property changes character only by a written transmutation under § 852. Exceptions (§ 852(c) personal gifts; pre-1985 transmutations) are taught in chapter 3.

Περίπτωση

In re Marriage of Valli, (2014) 58 Cal.4th 1396 (California Supreme Court 2014)

Γεγονότα

During marriage the husband bought a life insurance policy on his own life with community funds and named his wife as the owner. At divorce the wife claimed the policy as her separate property under the form-of-title presumption in Evidence Code § 662.

Κράτημα

The transmutation statutes, not the form-of-title presumption in Evidence Code § 662, decide the character of property bought with community funds and titled in one spouse’s name. There was no express written declaration under § 852, so the policy remained community property.

Γιατί έχει σημασία

Title in one spouse’s name alone does not change community property into separate property. If the facts say “deed in her name only”, write the presumption, then look for a written transmutation. Without one, the asset stays community.

Three related rules belong to later chapters. First, § 2581 presumes that property held in joint form is community property at dissolution (chapter 2). Second, § 803 presumes that property a married woman took by a writing before 1975 is her separate property (chapter 2). Third, when a transaction between spouses gives one spouse an advantage, the § 721 fiduciary duty raises a presumption of undue influence. That presumption prevails over the title presumption (In re Marriage of Haines (1995) 33 Cal.App.4th 277; chapter 5).

The house in his name

Grace and Henry marry in 2016 and live in San Diego. Henry deposits his dentist salary into a checking account that has been in his name alone since before the marriage. The account had a zero balance on the wedding day. In 2020 Henry uses $150,000 from that account as the down payment on a house. The deed names “Henry, a married man, as his sole and separate property.” Grace never contributed money to the account. In 2026 the couple separates, and Henry claims the house as his separate property because of the deed and because Grace contributed nothing.

Is the house community property or Henry’s separate property?

Ανάλυση

The issue is whether Henry can rebut the community property presumption for the house. Under Family Code § 760, property acquired during marriage while domiciled in California is presumed community property, and the spouse claiming separate property must prove it by a preponderance of the evidence. Here, the house was acquired in 2020, during the marriage, in California, so it is presumed community. Henry must rebut by tracing, agreement or statute. Tracing fails: the account was empty on the wedding day, so the down payment came from salary earned during marriage, so the account held community funds even though it was in his name. Agreement fails: the deed’s words “sole and separate property” are a statement of title, not an express written declaration by Grace under § 852, and under Valli the form-of-title presumption does not apply. No statute makes the house separate. Henry will argue that Grace contributed nothing, but contribution is irrelevant: each spouse owns one-half of community earnings regardless of who earned them (§ 751). Therefore, the house is community property, and the court will divide it equally at dissolution.

Σημείο κλειδί

Ask three questions for every asset: When was it acquired? Where did the money come from? Is there a writing that changes the character?

Συμβουλή για τις εξετάσεις

Write the presumption sentence for every asset before you analyze it. For example: “Because the house was acquired during marriage, it is presumed community property, and Henry must prove otherwise.” Then test tracing, agreement and statute. Tested on 26 of the last 50 exams.

The spouse who claims community property needs to show only that the asset was acquired during marriage. Write this allocation expressly, because graders look for the words “burden” and “preponderance”.

Βασικές σημειώσεις

  1. 1.Property acquired during marriage is presumed community; the separate property claimant proves otherwise by a preponderance.
  2. 2.Three rebuttal routes: tracing to a separate source, a valid agreement or transmutation, or a statute (T-A-S).
  3. 3.Commingling does not change character, but the claimant must trace asset by asset (See v. See).
  4. 4.Title in one spouse’s name alone does not rebut the presumption; § 662 does not apply where it conflicts with the transmutation statutes (Valli).
  5. 5.Contribution is irrelevant: the non-earning spouse owns half of community earnings from the start.

1.5 Who is covered: spouses, domestic partners, putative spouses and cohabitants

Section 760 speaks of a “married person”, so the community property system applies only to relationships the law recognizes. Between the two extremes sit two groups the exam likes. Registered domestic partners are treated like spouses. Putative spouses believed in good faith that they were married.

Κανόνας

Spouses: a valid marriage

Marriage is a personal relation arising out of a civil contract between two persons who are capable of consenting and do consent. Consent alone is not enough; it must be followed by the issuance of a license and by solemnization. A validly married person acquires community property from the date of the ceremony.

California has no common-law marriage: living together or sharing a name does not create a marriage here. However, § 308 recognizes a marriage validly contracted in another state, including a common-law marriage formed where the law allows it. On the exam, assume the marriage is valid unless the facts show a defect: a missing license, a defective ceremony or a prior marriage never dissolved.

Cal. Fam. Code § 297.5

Fam. Code § 297.5(a)

Registered domestic partners shall have the same rights, protections, and benefits, and shall be subject to the same responsibilities, obligations, and duties under law, whether they derive from statutes, administrative regulations, court rules, government policies, common law, or any other provisions or sources of law, as are granted to and imposed upon spouses.
Ανοιχτό κώδικα

A registered domestic partnership is created by filing a Declaration of Domestic Partnership with the California Secretary of State (§ 297). Once registered, the partners have every property right and duty of spouses. Their earnings are community property, and §§ 771, 2550 and Probate Code § 100 all apply. When an essay says “registered domestic partners”, write § 297.5 in one sentence, then analyze the facts as a marriage.

putative spouse – A person whose marriage is void or voidable but who believed in good faith that the marriage was valid. The court gives that person the property rights of a spouse.Cal. Fam. Code § 2251

quasi-marital property – Property acquired during a void or voidable marriage that would have been community or quasi-community property if the marriage had been valid. A putative spouse may ask the court to divide it.Cal. Fam. Code § 2251(a)(2)

Κανόνας

Putative spouses and quasi-marital property

When a marriage is void or voidable and a party believed in good faith that it was valid, the court declares that party a putative spouse. Property acquired during the union that would have been community or quasi-community property is quasi-marital property. The court divides it like community property, but only if a party declared a putative spouse asks.

A putative spouse needs three things. First, a marriage ceremony or an attempted marriage. Second, a marriage that is void or voidable because of bigamy, a missing license or a defect in the ceremony. Third, a good-faith belief that the marriage was valid. The typical exam fact is a prior divorce never made final: the claimant marries, buys a house with earnings, then learns of the earlier marriage.

Good faith is subjective: did this person honestly believe the marriage was valid? Reasonableness is evidence of honesty, not a separate requirement. Good faith also has an end. Once the claimant learns that the marriage is invalid, later acquisitions are not quasi-marital property.

Περίπτωση

Ceja v. Rudolph & Sletten, Inc., (2013) 56 Cal.4th 1113 (California Supreme Court 2013)

Γεγονότα

The claimant married a man in a formal ceremony, but his divorce from his earlier wife was not yet final. After he died in an accident, she sued for wrongful death as his putative spouse. The defendants argued that her belief in the marriage was not objectively reasonable.

Κράτημα

Good faith is a subjective test: whether the claimant honestly believed the marriage was valid. The court considers all the circumstances, including the reasonableness of the belief, as evidence of honesty, but it does not require the belief to be objectively reasonable.

Γιατί έχει σημασία

Write the test as “honest belief, judged in light of all the circumstances”; the same test governs § 2251 property division.

Σημείο κλειδί

At death a putative spouse is treated as a surviving spouse (Estate of Leslie). If only one party acted in good faith, that party still receives the protection of § 2251.

Κανόνας

Unmarried cohabitants: no community property

Unmarried partners who live together acquire no community property, even after many years. Each keeps what he or she earns. A partner may recover only under contract or equity. The routes are an express agreement, an agreement implied from conduct, or restitution such as quantum meruit or a constructive trust.

Περίπτωση

Marvin v. Marvin, (1976) 18 Cal.3d 660 (California Supreme Court 1976)

Γεγονότα

The plaintiff lived with the actor Lee Marvin for about seven years without marrying him. She alleged an oral agreement to share all earnings and property acquired during the relationship, and said she gave up her career to be his companion and homemaker.

Κράτημα

The Family Law Act does not govern the property of unmarried cohabitants. Courts enforce express contracts between cohabitants except to the extent the contract is founded on sexual services. Courts may also find an implied contract from conduct and may award equitable relief such as quantum meruit or a constructive trust.

Γιατί έχει σημασία

A Marvin claim is a contract claim, not a community property claim. Write Marvin whenever the parties never married and there is no putative spouse.

Three cautions about Marvin. First, sexual companionship cannot be the consideration. Second, the agreement may be implied: pooling earnings and acting as an economic partnership can show an implied contract. Third, the remedy follows the contract, not § 2550; a partner with no agreement may still seek the reasonable value of services in quantum meruit.

Παράδειγμα

Twenty years, no wedding

Ivy and Jun live together in Oakland for twenty years without marrying. Jun earns a large salary and buys a house in his own name. Ivy manages the household and Jun’s finances. Jun often says, “Everything I have is half yours.” They separate.

Ανάλυση

There is no community property, because Ivy and Jun were never married and neither believed they were. Under Marvin, Ivy may sue on Jun’s repeated promise as an express oral contract. She may also plead an implied contract from twenty years of pooled effort, or seek quantum meruit.

Αποτέλεσμα

Ivy’s recovery is measured by the contract or the value of her services, not by an equal division of the house.

After July 2028

The NextGen exam replaces the current format from July 2028. It adds family law under general U.S. principles, but it does not test California community property rules. A California component for July 2029 is proposed but not approved. Candidates sitting in February 2027, July 2027 or February 2028 must know this subject in full.

Συμβουλή για τις εξετάσεις

If the facts show a defect in the marriage, run three tests in this order: valid marriage under § 300, putative spouse under § 2251, then Marvin contract. Stop at the first one that fits. Putative spouse: 3 of the last 50 exams; Marvin: 2.

Βασικές σημειώσεις

  1. 1.Only spouses and registered domestic partners acquire community property; § 297.5 makes partners identical to spouses.
  2. 2.A putative spouse honestly believed the void or voidable marriage was valid; the test is subjective (Ceja).
  3. 3.Quasi-marital property is divided like community property (§ 2251); good faith ends at knowledge of the defect.
  4. 4.Unmarried cohabitants have no community property; Marvin allows express or implied contracts and equitable remedies.

1.6 The Community Property essay method

A Community Property essay is the most predictable essay on the California Bar Exam. The facts describe a couple, a marriage date, a list of assets and debts, and a separation or a death. The call asks what each spouse takes. This section gives you the grader’s checklist, a fill-in paragraph for each asset, and a table that links each call to the rule you must state.

Στοιχεία

The Community Property checklist

Write your answer in this order.

  1. 1.Opening: California is a community property state. State the three dates: marriage, separation, and divorce or death.
  2. 2.Status: Confirm the relationship: valid marriage, registered domestic partnership, putative spouse or cohabitants.
  3. 3.Per asset: presumption: Acquired during marriage? Then presumed community; the separate property claimant must prove otherwise.
  4. 4.Per asset: source: Earnings, gift, inheritance, premarital property, or out-of-state acquisition (quasi-community).
  5. 5.Per asset: title and agreement: Joint title (§ 2581), premarital agreement, or written transmutation (§ 852).
  6. 6.Per asset: tracing and apportionment: Commingled funds, separate business with community labor, community payments on a separate asset.
  7. 7.Per asset: conclusion: State the character and each spouse’s share, including any reimbursement.
  8. 8.The call: Management, creditors, division at divorce (§ 2550), or distribution at death (Prob. Code §§ 100 to 101).

The four-step characterization paragraph

For every asset, write these four steps in order. Then apply the call to the conclusion.

  1. 1.Step 1: The presumption that follows from the date of acquisition.
  2. 2.Step 2: The source of the funds or labor.
  3. 3.Step 3: The effect of title, agreement or tracing.
  4. 4.Step 4: The conclusion, with each spouse’s share.

Ζήτημα
Whether [the asset] is community property, separate property or quasi-community property, and what share each spouse takes.
Κανόνας
Under Family Code § 760, property acquired by either spouse during marriage while domiciled in California is presumed community property. Under § 770, property owned before marriage or acquired by gift, bequest, devise or descent is separate property, as are its rents and profits. The spouse claiming separate property must rebut the presumption by a preponderance of the evidence, by tracing to a separate source, by a valid agreement or transmutation, or by statute. Title in one spouse’s name alone does not rebut the presumption (Valli).
Εφαρμογή
Here, [the asset] was acquired on [date], which is [during / before / after] the economic community that ran from [marriage date] to [separation or death date]. So it is presumed [community / separate]. The funds came from [salary during marriage / an inheritance / a premarital account / earnings while domiciled in another state]. [Spouse] will argue that [title / a writing / tracing] makes it separate. However, [the deed is only a statement of title and there is no express written declaration under § 852 / the records do not trace the funds / no statute applies]. [Other spouse] will respond that [contribution is irrelevant under § 751 / the funds were commingled and community expenses are presumed paid from community funds].
Σύναψη
Therefore, [the asset] is [community / separate / quasi-community] property, and at [divorce / death] [spouse] takes [one-half / all / nothing] of it.

Headings carry points. Use the asset name as the heading, in the order the facts present the assets: “The house”, “The savings account”, “The bonus”. Under each heading, write the four-step paragraph. If an asset raises two issues, give each its own sub-heading. A grader who can find every issue in ten seconds grades generously.

Υποθετικός

A model asset paragraph

Mia and Noah married in 2018. In 2021 Noah’s mother died and left him $100,000. Noah put the money in a new account in his own name and never added to it. In 2026 the couple separated. Noah claims the account.

Write the asset paragraph for the account in the house form.

Ανάλυση

The account. The issue is whether the $100,000 account is Noah’s separate property. Property acquired during marriage is presumed community property under § 760, and Noah must prove otherwise. However, under § 770(a)(2), property acquired by bequest or descent is separate property. Here, Noah received the money from his mother’s estate in 2021, and he kept it in a separate account that received no community funds. Noah can therefore trace the account to a separate source. Mia will argue that the account was acquired during marriage, but the source, not the date, controls once tracing succeeds. Therefore, the account is Noah’s separate property, and Mia takes no share of it at divorce. (Seven sentences, one issue, two statutes, both sides, one conclusion. That is the target for every asset.)

Ανοιχτό κώδικα

Section 2550 is the divorce consequence. The omitted words let the court divide in the judgment or later if it reserves jurisdiction. The community estate, which § 63 defines as community and quasi-community property, is divided equally. Separate property is confirmed to its owner and not divided.

At death the rule is different. Probate Code § 100 gives one-half of the community property to the survivor and one-half to the decedent’s estate. The decedent’s will controls only the decedent’s half and the decedent’s separate property. Chapters 7 and 9 give the exceptions.

Σημείο κλειδί

Every call reduces to one question: what is the character of the asset? Characterize first, then apply the rule the call names.

Προειδοποίηση

Words that cost points

Do not write “marital property”, “equitable distribution”, “joint property” or “alimony”. These are terms from other states. Write “community property”, “separate property”, “quasi-community property”, “equal division” and “spousal support”. Wrong vocabulary signals that the writer does not know California law.

Time management decides Community Property scores more than knowledge does. Spend the first eight minutes reading the facts twice and listing every asset and debt with its date and a provisional label. With five assets, that leaves about ten minutes per asset. Then write, and never leave an asset unanswered.

Συμβουλή για τις εξετάσεις

Argue both sides for every contested asset, then conclude in one sentence. Graders give points for the separate property argument even when you reject it. Never leave an asset without a conclusion; a guessed conclusion scores, a blank does not.

Βασικές σημειώσεις

  1. 1.Open with the three dates and the status of the relationship; then give each asset its own heading.
  2. 2.Four steps per asset: presumption, source, title or agreement or tracing, conclusion with shares.
  3. 3.Divorce: § 2550 equal division of the community estate. Death: Prob. Code § 100 halves.
  4. 4.Use California vocabulary only: community, separate, quasi-community, equal division.
  5. 5.About ten minutes per asset; a complete short paragraph for every asset beats a long one for some.

1.7 Review

This Review tests the four skills of the chapter. First, labeling an asset as community, separate or quasi-community property. Second, fixing the start and end of the economic community. Third, applying and rebutting the § 760 presumption. Fourth, identifying who the system covers. Answer each question before you open the explanation. The fifth item is a 15-minute essay drill. Write it in full, then compare your paragraphs with the model answer.

Κανόνας

The five statutes behind the questions

Five statutes decide the questions below. § 760: property acquired during marriage while domiciled in California is community property. § 770: premarital property, gifts and inheritances are separate. § 771: earnings after separation are separate. § 125: out-of-state acquisitions that would be community are quasi-community. § 2251: a putative spouse may have quasi-marital property divided.

How to use the essay drill. Set a timer for 15 minutes. Read the facts twice and write the three dates at the top of your page. Give each asset a heading and write the four-step paragraph from section 6. Do not look at the options until you have finished writing. Then compare your answer with the model answer sentence by sentence. Mark every model sentence that has no match in your answer; those are the rules and facts a grader expected.

Σημείο κλειδί

A practice question is only useful if you write the rule and the reason before you read the options. Guessing from the options trains recognition; the essay day needs recall.

A husband and wife married in 2019 and have lived in San Jose since the wedding. The wife worked as a software engineer throughout the marriage. Her employer deposited her salary into a checking account in her name alone. She opened the account before the marriage, and it had a zero balance on the wedding day. The husband never deposited money into the account and never withdrew money from it. In 2026 the spouses separated. On the date of separation the account held $180,000, all of it salary the wife earned during the marriage. Nothing has been deposited since. The wife claims the account as her separate property because of the title and because the husband contributed nothing. The husband claims one-half. Under California law, what is the most likely result?

Under Family Code § 760, property acquired by a married person during marriage while domiciled in California is community property, and under § 751 each spouse owns a present, equal half regardless of who earned it. Here, every dollar in the account is salary earned during the marriage in California, so the funds are community property. Title in the wife’s name alone does not rebut the presumption (In re Marriage of Valli), and the husband’s lack of contribution is irrelevant. Option A confuses the date the empty account was opened with the date the funds were acquired. Option C treats contribution as the test; it is not. Option D misuses quasi-community property, which concerns acquisition while domiciled outside California.
B. Earnings during marriage are community property under § 760 whatever the title. The account was empty when the marriage began, so nothing in it was owned before marriage. The wife cannot trace to a separate source, points to no agreement or transmutation, and cites no statute. The husband takes one-half.

Under Family Code § 770(a)(2), property acquired by a spouse during marriage by gift, bequest, devise or descent is separate property. The § 760 presumption applies because the money arrived during marriage, but the husband rebuts it by statute and by tracing: the source was his mother’s will, and the account never received community funds. Here, the money is a bequest, and the record shows no commingling, so the husband proves separate character by a preponderance. Option A ignores the § 770 exception. Option B states the presumption but wrongly assumes it cannot be rebutted. Option D misreads quasi-community property, which turns on the domicile of the acquiring spouse, not of the donor.
C. The presumption is rebutted by statute (§ 770(a)(2)) and by tracing. The husband kept the inheritance in a separate account with no community deposits, so the source is clear. The wife takes nothing from this account at divorce.

Under Family Code § 125, quasi-community property is property acquired by a spouse while domiciled outside California that would have been community property if the spouse had been domiciled in California at the time. At dissolution the court treats quasi-community property as community property and divides it equally under § 2550. Here, the wife bought the stock with her salary while domiciled in Oregon; salary earned during marriage would have been community property in California, so the stock is quasi-community property. Option B fails because § 760 requires California domicile at acquisition. Option C states the general rule that character is fixed at acquisition but ignores the statutory quasi-community property override at divorce. Option D relies on title, but the name on the account does not decide the character of property bought with earnings.
A. Section 760 does not reach the Oregon years, but § 125 does. The stock is quasi-community property, treated as community property at divorce. The husband takes one-half.

Under Family Code § 2251, when a marriage is void or voidable and a party believed in good faith that it was valid, the court declares that party a putative spouse and divides the property that would have been community property as if it were community property; that property is called quasi-marital property. Here, the woman went through a formal ceremony and had no knowledge of the prior marriage, so she honestly believed the marriage was valid (Ceja). The house was bought with the man’s earnings during the union, which would have been community property, so it is quasi-marital property divided equally. Option A ignores § 2251. Option B applies Marvin, which governs only cohabitants who never believed they were married. Option C invents a contribution-based tenancy that California does not use.
D. Run the three tests in order. No valid marriage (bigamy). Putative spouse: yes, honest belief after a formal ceremony. So § 2251 applies and Marvin is not needed. The house is quasi-marital property, and the woman takes one-half regardless of title.

Essay drill (15 minutes). A husband and wife married in Sacramento in 2020. On March 1, 2026, the wife told the husband the marriage was over and moved out. Neither spouse ever signed an agreement about property. Three assets are in dispute. (1) A car that the husband bought in 2018 for $30,000. He still drives it. (2) A $40,000 check from the wife’s parents, given at the wedding. The card read “For our daughter.” She deposited it in an account in her name. (3) A $60,000 bonus that the husband’s employer paid him on June 30, 2026. The bonus rewarded sales he made between July 1, 2025 and December 31, 2025. The wife claims one-half of the car and the bonus. The husband claims one-half of the wedding check. What are the rights of each spouse in the three assets? Discuss according to California law. Which of the following states the correct characterization of all three assets?

Απάντηση: B

The car was owned before marriage, so it is the husband’s separate property under § 770(a)(1). The wedding check was a gift, and the card shows it was given to the wife alone, so it is her separate property under § 770(a)(2); a gift to both spouses would have belonged to both of them. The bonus was paid after separation, but under § 771 the question is when the work was done, not when the money arrived. The sales were made from July to December 2025, during the economic community, so the bonus is community property. Option A treats the car and the check as community because the marriage existed. Options C and D treat the bonus as separate because of its payment date, which is the trap in this pattern.
California is a community property state. The economic community ran from the 2020 marriage to March 1, 2026. On that date the wife expressed her intent to end the marriage, and her conduct in moving out was consistent with that intent (Fam. Code § 70). The car (asset 1). The issue is whether the car is the husband’s separate property. Under § 770(a)(1), property owned before marriage is separate property. Here, the husband bought the car in 2018, two years before the wedding. The presumption of § 760 does not apply, because the car was not acquired during marriage. The wife may argue that community funds paid for upkeep, but the facts show no such payments. Therefore, the car is the husband’s separate property. The wedding check (asset 2). The issue is whether the $40,000 gift is community or separate property. Assume the check arrived during marriage, so § 760 presumes community property and the wife must rebut. Under § 770(a)(2), property acquired by gift is separate property. Here, the card read “For our daughter,” which shows that the donors intended a gift to the wife alone, and she kept the money in her own account. The husband will argue that a wedding gift is given to the couple. However, the donors’ words show a gift to one spouse, and the funds were never commingled. Therefore, the check is the wife’s separate property. The bonus (asset 3). The issue is whether a bonus paid after separation for work done before separation is community property. Under § 771, earnings after the date of separation are separate property, but earnings are separate only if the labor occurred after separation. Here, the bonus rewarded sales made from July to December 2025, before the March 1, 2026 separation. The payment date of June 30, 2026 does not matter. The husband will argue that he received the money after the community ended. However, the community owns the fruits of community labor whenever they are paid. Therefore, the bonus is community property, and the wife takes one-half.

– The process of labeling an asset as community, separate or quasi-community property by its time and manner of acquisition.

– The date of a complete and final break in the marriage, shown by expressed intent to end it and consistent conduct (Fam. Code § 70).

– The state where a person lives with the intent to remain indefinitely; a person has one domicile at a time.

– Proving with records that an asset was bought with separate funds, so that it keeps its separate character.

– Mixing separate and community funds in one account or asset, which does not change their character but makes tracing necessary.

– An agreement between spouses that changes the character of property; valid only by an express written declaration (Fam. Code § 852).

– A relationship created by filing a declaration with the California Secretary of State; partners have all the rights and duties of spouses (§ 297.5).

– The California term for divorce; the judgment that ends the marriage and divides the community estate equally (§ 2550).

– The standard of proof for rebutting the community property presumption: the fact is more likely true than not.

– To overcome a presumption by proving, to the required standard, that the presumed fact is not true.

– The rule of Fam. Code § 2550 that the court divides the community estate in equal halves at dissolution.

– All community property and quasi-community property of the spouses (Fam. Code § 63); the court divides it equally at dissolution (§ 2550).

Chapter summary

  1. 1.Three boxes: community (§ 760), separate (§ 770) and quasi-community (§ 125). Time and manner of acquisition decide the box.
  2. 2.Title alone does not decide character; joint title matters at divorce under § 2581 (chapter 2).
  3. 3.The economic community ends at separation (§ 70), death or judgment; later earnings are separate (§ 771), judged by when the work was done.
  4. 4.Property acquired during marriage is presumed community; the separate property claimant rebuts by tracing, agreement or statute.
  5. 5.Registered domestic partners are spouses (§ 297.5); putative spouses divide quasi-marital property (§ 2251); cohabitants have only Marvin contract rights.
  6. 6.Per asset: presumption, source, title or agreement, conclusion. Then answer the call: divorce (§ 2550) or death (Prob. Code § 100).
