Why non-native English speakers fail the California Bar, and what to do about it
Foreign-admitted attorneys passed the February 2026 California Bar Exam at 22.2%, about half the 43.9% rate of first-time takers overall. The State Bar does not say why. Four features of the exam explain much of the gap, and each has a fix you can schedule.

Foreign-admitted attorneys passed the February 2026 California Bar Exam at 22.2%, and at 18.2% in July 2025 (February 2026 statistics; July 2025 statistics). In the same February sitting, first-time takers as a whole passed at 43.9% (February 2026 results). The full tables by sitting and applicant group are in our pass-rates post.
The State Bar publishes no data on English ability, so it does not say why the gap exists. What we can describe is the exam itself. Four of its features weigh most on a lawyer who reads English as a second language, and each one can be trained.
1. The MBE clock
The MBE is 200 questions in two three-hour sessions, which is 1.8 minutes, or 108 seconds, per question (July 2026 exam page). A reader who needs 2.5 minutes per question answers about 72 of each 100 and leaves the rest to guesswork.
The fix is practice at the real pace, not faster reading in general. Answer sets on a timer from the first weeks, review every wrong answer against its explanation, and track your seconds per question the way you track accuracy.
2. Essay structure
Every essay and the Performance Test is graded from 40 to 100 in 5-point steps, and the written day is half of the total score (scoring guide). Graders read quickly. An answer that names each issue in a heading, states the rule and then applies the facts is simpler to credit than the same knowledge in continuous prose.
The fix is a fixed shape: one numbered heading per issue, Issue, Rule, Application, Conclusion, in short sentences. Our study guide for non-native speakers sets out the template and six writing rules.
3. The subjects the MBE never tests
Six of the 13 essay subjects never appear on the MBE, and Community Property and Wills and Succession are tested on California law only (Scope of the Exam). MBE practice alone does not reach them, and a lawyer trained in another system has usually never studied the California rules.
The fix is to schedule those subjects early, not in the last month. Read chapter 1 of each, then write one timed essay per subject before the review phase begins.
4. No fixed weekly rhythm
Reading outlines feels productive and leaves no record of what you can do under time pressure. A plan that repeats the same week (read, practice, write, review) shows early which subjects cost you points.
The fix is a day-by-day plan from your exam date and your weekly hours. AntCABar's study plan builds one and moves missed tasks forward when you fall behind.
